The following Terms and Conditions of BSN’s AI Chatbot (“Terms”) is intended to inform users on the terms of use, limitations and guidelines of BSN’s Chatbot (“Chatbot”). The Chatbot is available through a pop-up window on BSN’s websites (www.bsn.com.my and www.mybsn.com.my), BSN’s official social media platforms on Facebook DM at BSN Malaysia and via WhatsApp at 03-26131919 (“Social Media Platforms”). By interacting with the Chatbot on BSN website or BSN’s Social Media Platforms, you agree to the same terms outlined herein, in addition to the Social Media Platforms’ own Terms of Service. Before you proceed to engage with the Chatbot, please read these Terms and the Social Media Platforms’ Terms of Service carefully.
AI CHATBOT FUNCTIONALITY
The Chatbot is an automated chatbot powered by Artificial Intelligence (AI) technology and is designed to assist you with basic inquiries and to provide general information on BSN’s products and services.
We suggest that the responses from the Chatbot may be used as a starting point and would recommend that you verify the information through our official banking platforms.
INFORMATION ACCURACY
While we have put in every effort to ensure that the Chatbot’s responses are accurate and helpful, you have understand and agreed that the Chatbot uses AI that is continuously learning to communicate with you and has a limited capacity to answer specific queries that you particularly seek.
USER RESPONSIBILITY
By using the Chatbot, you are deemed to have read, understood and agreed to these Terms and the Social Media Platforms’ Terms of Service (if applicable) and you agree to take full responsibility on decisions or actions you make based on the information provided.
Users of the Chatbot bear sole responsibility for their interactions and reliance on the information provided. It is important to exercise caution while interpreting and acting upon the Chatbot's responses. We encourage you to exercise your due diligence when making any decisions.
While using the Chatbot, you agree that (i) no licenses or rights are granted to you, by implication or otherwise; (ii) you will not send any material that may be considered to be defamatory, fraudulent or otherwise unlawful information or communication, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, illegal, indecent, or otherwise harmful to others; (iii) you will not perform any activities which may damage or disrupt the proper functioning of the Chatbot; (iv) you are not permitted to change, bypass or break the security measures of the Chatbot, or take unlawful act that will impact the Chatbot in any way causing damage and/or overloading to its software; and (v) you will not reverse engineer, decompile, disassemble or translate or otherwise attempt to derive the source code of any part of the Chatbot.
DATA SECURITY
During your interaction with the Chatbot, BSN has the right to collect and process certain information including but not limited to your inputs, queries, and preferences to enhance the Chatbot’s quality of responses. These data from the conversations will not be used to train other chatbot or AI models, ensuring your privacy and data security.
You agree to protect your own sensitive details such as your password, MyKad number, payment details or bank account number and avoid sharing any sensitive details through the Chatbot on BSN Website or on the Social Media Platforms. While BSN makes every effort to protect your information, communications via the Social Media Platforms are subject to the respective Social Media Platforms’ own security protocols. Please read our Privacy Policy at our website www.bsn.com.my to understand how we collect, use, process and disclose your personal data. AVAILABILITY
Although BSN will make every effort to keep the Chatbot up and running, the Chatbot may not be available at all times due to maintenance or technical or connectivity issues. Further, BSN does not guarantee the access, performance, speed, reliability or availability of the Chatbot for your use.
BSN reserves the right to terminate or suspend your access to the Chatbot at any time without notice. Notwithstanding that, if BSN believes that you may have breached these Terms or for any other reason including but not limited to suspicious or unlawful or fraudulent conduct, or if the use of the Chatbot would create harm, risk, or possible legal exposure to BSN, even if access continues to be allowed for other users. BSN may also, in its sole discretion, discontinue the Chatbot at any time and for any length of time.
You agree that BSN shall not be liable to you or any third party for performance, non-performance, or unavailability of the Chatbot or for any termination or suspension of your access to the Chatbot.
EXCLUSION OF LIABILITY
BSN or its affiliates, officers and/or employees cannot be held responsible or liable for any losses, damages, or inconveniences resulting from the (i) use of the Chatbot or reliance on the information provided; or (ii) any errors or omissions or insufficiency in the responses and information provided by the Chatbot; or (iii) the Chatbot’s inability to provide you with the information that you specifically sought; or (iv) any disruption or intermittent service of the Chatbot; or (v) any costs, loss or damages arising from your use of, or inability to use or access, or a failure, suspension or withdrawal of all or part of the Chatbot at any time.
To the extent permitted by law, BSN is not liable for any special, indirect or consequential damages or any damages whatsoever, whether in an action of contract, negligence or other tortuous action, arising out of, or in connection with the performance of, or use of the Chatbot.
BSN expressly disclaims any liability for actions taken by you based on the responses and information given through the Chatbot.
When you use the Chatbot on the Social Media Platforms, you are also subject to the Social Media Platforms’ own Terms of Service and any other policies in relation to its use. BSN does not control Social Media Platforms’ systems, and BSN is not responsible for any service interruptions, or issues arising from your use of the Social Media Platforms. BSN shall not be liable for any losses, damages, or inconveniences resulting from service outages, message delivery failures, data breaches or any other issues caused by the Social Media Platforms.
You shall defend and pay all costs, losses, damages, awards, fees (including any reasonable legal fees) and judgments awarded against BSN arising from your reliance, either partly or wholly, on the Chatbot’s responses, and shall provide BSN with notice of such actions, full authority to defend, compromise or settle such claims, and reasonable assistance necessary to defend such actions, at your sole expense.
NO WARRANTY
BSN does not warrant the accuracy, security, reliability, completeness, timeliness of the content, nor shall BSN be regarded as making representation, undertakings, guarantees, assurances of the content provided by the Chatbot.
To the extent permitted by law, BSN disclaims all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties' rights, and fitness for a particular purpose.
THIRD-PARTY CONTENT
The Chatbot may provide links, pointers to third-party websites and contents (“Third-Party Content”) only as a convenience. This Third-Party Content may not be within BSN’s control and as such BSN is not responsible for such Third-Party Content and/or for the products or services on or available from those Third-Party Content.
BSN does not assume any responsibility or liability for any information or content available in such Third-Party Content. You acknowledge the sole responsibility for and assume all risk arising from, your use or access of any Third-Party Content.
VARIATION
BSN reserves the right to amend, modify, change, delete, add or vary these Terms at any time without notice at BSN’s absolute and sole discretion. The amended Terms shall become effective upon its publication on BSN website or at any of BSN’s Social Media Platforms or any other manner as BSN deems fit. You shall be deemed to have agreed and accepted such amendments of these Terms without reservation if you continue to access and use the Chatbot.
INTELLECTUAL PROPERTY
All intellectual property rights ("Intellectual Property") that are found in the Chatbot, other than the intellectual property that belongs to the respective Social Media Platforms, are either the sole property of BSN or its affiliates or third parties. You may not copy, reproduce, modify, lease, loan, sell, create derivative works from, upload, transmit, or distribute any Intellectual Property associated with the Chatbot in any way without BSN’s or the appropriate third party's prior written permission. Except as expressly provided herein, BSN does not grant to you any express or implied rights to BSN’s or any third party's Intellectual Property.
NO RELATIONSHIP
Reliance on the Chatbot does not create a customer relationship or any other contract between you and BSN. The responses and information provided by the Chatbot are not privileged or confidential and should not be treated as professional advice or be perceived as a substitute for a consultation with a qualified professional.
SEVERANCE
Where any term of this Terms is illegal or unenforceable or deemed to be illegal or unenforceable, the relevant term shall continue to apply with the necessary modification in order that the term is made legal, valid and enforceable. In the event that it is not possible to modify the relevant term to make the term as legal, valid and enforceable, then such part of the term, which is illegal, invalid or unenforceable shall be severed but the remaining parts of the term shall remain unaffected.
WAIVER
No failure or delay on the part of BSN in exercising any rights or remedies under these Terms at any time or for any period of time, nor any knowledge or acquiescence by BSN of any breach of any provision of these Terms shall operate as or be deemed to be a waiver thereof nor shall a waiver by BSN of any breach constitute a continuing waiver in respect of any subsequent or continuing breach. Any waiver of any right or remedy of BSN under these Terms shall only be valid and effective if it is agreed to by BSN in writing.
GOVERNING LAW
These Terms are governed by and will be construed according to the laws of Malaysia and we each irrevocably agree to submit to the exclusive jurisdiction of the courts of Malaysia.
